Terms of sale

The owner of the online store SPORTSERVICE.EE (hereinafter the Online Store) is OÜ Sportservice (registry code 10329675), located at Juubelitammede tee 7, Saku, Harjumaa.


Validity of the sales contract, product and price information


The terms of sale apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products. If the price is not displayed, a separate inquiry must be submitted to obtain the price of that product. Delivery fees are added to the prices. The delivery cost depends on the unloading location, the delivery method, and the weight and dimensions of the purchased goods.

The delivery cost is shown to the buyer when the offer is prepared. Information about the goods is provided in the Online Store directly next to the product.


Placing an offer request


To request a product offer (hereinafter the “offer”), the desired products must be added to the inquiry cart. To place an offer request, the required data fields must be filled in and a suitable delivery method selected.

Sportservice OÜ will then send the customer an offer that includes the prices of the goods and services. If the conditions of the offer are acceptable, the Customer confirms the order and thereby agrees to the terms stated in the offer. Sportservice will then issue an invoice to the buyer according to the conditions and prices stated in the offer. The contract enters into force once the payable amount has been received in the bank account of Sportservice OÜ. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed as soon as possible and the paid amount (including delivery costs) will be refunded without delay, but no later than within 14 days from the date of sending the notice.


Delivery


Goods are shipped to the following countries: EU member states and Norway. The delivery costs are borne by the buyer, and the corresponding price information is shown in the offer and on the invoice.

Goods generally arrive at the destination specified by the buyer depending on the nature of the ordered goods and according to the conditions stated in the offer.


Right of withdrawal


After receiving the order, the buyer has the right to withdraw from the contract within 14 days. The right of withdrawal does not apply if the buyer is a legal person. To use the 14‑day right of withdrawal, the ordered goods may not be used in any way other than what is necessary to verify the nature, characteristics and functioning of the goods in the same manner as allowed in a physical store. If the goods have been used for purposes other than necessary to verify their nature, characteristics and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.

To return the goods, a withdrawal application must be submitted and sent to the e‑mail address sportservice@sportservice.ee no later than 14 days after receiving the goods. The cost of returning the goods is borne by the buyer, except when the reason for the return is that the item does not correspond to the order (e.g., wrong or defective item). The buyer must return the goods within 14 days after submitting the withdrawal application or provide proof that the goods have been handed over to the carrier within the aforementioned period. Upon receiving the returned goods, Sportservice OÜ will refund the buyer without delay, but no later than within 14 days from receiving the withdrawal application, all payments received from the buyer under the contract. Sportservice OÜ may refuse to issue refunds until the goods that are the subject of the contract have been returned or until the buyer has provided proof that the goods have been sent back, whichever occurs first. If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by Sportservice OÜ, Sportservice OÜ is not required to refund the cost that exceeds the cost of the standard delivery method. Sportservice OÜ has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the offer or on the invoice has been mistakenly indicated significantly below the market price.


Right to submit a complaint


Sportservice OÜ is liable for any non‑conformity or defect of the goods sold to the buyer that existed at the time of delivery and becomes apparent within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the goods to the buyer, it is presumed that the defect existed at the time of delivery. The Online Store must rebut this presumption. The buyer has the right to contact Sportservice OÜ regarding a defect within two months of discovering it by sending an e‑mail to sportservice@sportservice.ee or by calling +372 6726834. Sportservice OÜ is not liable for defects that have occurred after the goods were delivered to the buyer. If the goods purchased from Sportservice OÜ have defects for which Sportservice OÜ is responsible, Sportservice OÜ will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all payments related to the sales contract. Sportservice OÜ will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.


Direct marketing and processing of personal data


Sportservice OÜ uses the personal data entered by the buyer (including name, phone number, address, e‑mail address, bank details) only for processing the order and delivering the goods to the buyer.

Sportservice OÜ forwards personal data to transport service providers only for the purpose of delivering the goods. Sportservice OÜ sends newsletters and offers to the buyer’s e‑mail address only if the buyer has expressed a wish to receive direct marketing messages by entering their e‑mail address on the website and giving consent. The buyer may at any time opt out of receiving offers and newsletters by notifying us via e‑mail or by following the instructions provided in the marketing e‑mail.


Dispute resolution


If the buyer has complaints regarding Sportservice OÜ, they must be sent by e‑mail to sportservice@sportservice.ee or by calling +372 6726834. If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract between the buyer and the Online Store. Reviewing the buyer’s complaint in the committee is free of charge. The buyer may also contact the European Union’s online dispute resolution platform.
